Texas AG Sues Biden Administration

Texas AG Sues Biden Administration

28 News 01/23/2021 1330

(Democrats) AUSTIN, Texas - The Biden Administration's 100-day pause on deportations deemed low-risk was officially challenged by the State of Texas via a lawsuit filed by indicted Texas Attorney General Ken Paxton.

Paxton's lawsuit stems from secret agreements that Trump Administration DHS officials made with several states and local counties regarding immigration enforcement. Texas Governor Greg Abbott signed a similar agreement on Dec. 31, 2020, that states DHS "will consult with Texas before taking any action or making any decision that could reduce immigration enforcement, increase the number of removable or inadmissible aliens in the United States, or increase immigration benefits or eligibility for benefits for removable or inadmissible aliens." A violation of the agreement would entitle the other party to an injunction and that termination of the agreement would require a 180-day notice.

Legal experts agree that these agreements are not legally binding for the new President and his administration, not even considering the fact that it was signed by Ken Cucinelli, who was determined by the U.S. GAO to have been unlawfully appointed in a deputy capacity for DHS.

But that hasn't stopped Texas Attorney General Ken Paxton from making a political show with taxpayer money.

This is the same Ken Paxton that is still out on bond, was indicted on felony securities fraud charges five years ago, and still has not faced trial. He is currently under investigation by the FBI after his own top staffers formally accused him of bribery and abuse of office.

Texas Democratic Party Chair Gilberto Hinojosa issued a statement:

"The amount of hatred towards migrant families by Republican leadership is something that never ceases to amaze me. Ken Paxton seems to have no problem with grossly wasting taxpayer money to score political points, even though Trump left office without doling out a pardon to the indicted attorney general. This is nothing but a sad attempt to keep Trumpism alive when we have a new leader in the White House and, at last, new hope for millions of Texans who had their rights violated for four years. Paxton is an embarrassment to the office of the state attorney general and to the State of Texas."
